Welcome to Kevin Bowyer Photography. By accessing or using our services, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our services.
1. Introduction
Kevin Bowyer Photography ("we," "us," or "our") offers photography services to clients ("you," "your," or "client"). By hiring our services, or using our photos, you agree to the terms and conditions outlined in this agreement.
2. Copyright and Usage Rights
Copyright: Kevin Bowyer Photography retains the copyright to all images produced. We reserve the right to use the images for portfolio, marketing, and promotional purposes unless otherwise agreed upon in writing.
Client Usage: You are granted a non-exclusive license to use the images for personal use. Any commercial use of photographs without written consent will result in a $350 bill due immediately to Kevin Bowyer Photography. Failure to pay the invoice will result in legal action and additional fees for copyright infringement.
Discounted or Free Photos: Usage of discounted or free photos requires you to tag Kevin Bowyer Photography's Instagram and/or Facebook accounts in all social media posts where the photos are used. Any free photos where the photographer is not tagged in a social media post will incur a charge of $10 per photo, due immediately.
3. Model Release
By hiring our services or using our photos, you agree that we may use your likeness in the images for promotional purposes. If you do not wish to grant this permission, please notify us in writing prior to the session.
4. Limitation of Liability
Service Quality: We strive to deliver high-quality images; however, we are not liable for factors beyond our control, such as lighting conditions, weather, or venue restrictions that may impact the final images.
Event Disruptions: We are not liable for any disruptions or delays caused by events outside our control, including but not limited to natural disasters, accidents, or illness.
5. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Ohio.
6. Changes to Terms of Service
We reserve the right to update or modify these Terms of Service at any time. Any changes will be posted on our website and will take effect immediately upon posting.

By hiring Kevin Bowyer Photography, or using images captured by Kevin Bowyer Photography from public events, you acknowledge that you have read, understood, and agree to these Terms of Service.
